These Terms and Conditions ("Terms") govern your use of the services provided by Web Security Pro, a division of Internet Marketing Direct Pty Ltd ("we", "us", "our"), accessible via https://websecuritypro.com.au (the "Website").
By purchasing or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update these Terms from time to time without notice. It is your responsibility to review this page prior to placing any new order.
1. Our Services
We offer the following service tiers:
Ongoing Monthly Security & Maintenance Plans
- Essential — $197/month + GST. Foundational WordPress security and maintenance including firewall protection, real-time malware scanning, login attack prevention, smart IP blocking, automated encrypted offsite backups, hack recovery guarantee, free SSL certificate, monthly plugin and theme updates, and a monthly security report. No lock-in contract.
- Peace of Mind — $297/month + GST. Everything in Essential, plus weekly plugin and theme updates, WordPress core updates, plugin conflict resolution, uptime monitoring, speed optimisation checks, and a 12-hour priority support queue. No lock-in contract.
- Done For You — $397/month + GST. Everything in Peace of Mind, plus unlimited text and image changes (subject to fair use policy), quarterly performance reviews, a dedicated account manager, and VIP 4-hour priority support response. No lock-in contract.
One-Time Emergency Service
- Emergency Malware Remediation — $995 + GST (fixed incident fee). A comprehensive malware purge, backdoor removal, and security hardening service for WordPress websites that have already been compromised. Engineering work commences within 4 hours of credential intake submission. A 48-hour restoration guarantee applies.
All services are provided subject to these Terms. The specific deliverables, inclusions, and pricing for your selected service constitute the "Quote" for the purposes of these Terms.
2. Fees and Payment
- All fees are quoted in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. GST applies to all Australian clients.
- Monthly subscription fees are billed in advance via Stripe on a recurring monthly cycle commencing on the date of purchase.
- The Emergency Malware Remediation fee of $995 + GST is a fixed, one-time charge payable in full at the time of checkout before work commences.
- If you require services outside the scope of your selected plan, we will advise you of the additional fees before providing those services.
- We reserve the right to charge interest at 10% per annum on all overdue accounts, calculated monthly on outstanding balances.
3. Cancellation & Refunds
Monthly Plans (Essential, Peace of Mind, Done For You)
- There are no lock-in contracts. You may cancel your subscription at any time by providing 30 days written notice to [email protected].
- Your service will continue until the end of the current billing period. No partial-month refunds are issued.
- A 30-day money-back guarantee applies to new subscribers only. If you are not satisfied within the first 30 days of your initial subscription, contact us for a full refund of your first month's payment.
Emergency Malware Remediation
- Due to the immediate commencement of engineering resources upon checkout, the Emergency Malware Remediation fee is non-refundable once work has commenced.
- If you contact us prior to any work commencing and request a cancellation, a full refund will be issued at our discretion.
4. Service Delivery & Timeframes
- For monthly plans, initial setup and configuration will be completed within 2 business days of your subscription commencing.
- For Emergency Malware Remediation, engineering cleanup processes will commence within 4 hours of credential intake submission, with a 48-hour restoration SLA.
- We will use reasonable commercial endeavours to meet all stated timeframes. Timeframes are estimates and are not guaranteed. Delays caused by third-party hosting providers, incomplete credential submissions, or factors outside our control do not constitute a breach of our obligations.
5. Done For You — Fair Use Policy
The unlimited text and image changes included in the Done For You plan are subject to the following fair use policy:
- Changes are limited to text content, image swaps, and price updates on existing pages.
- Only one task will be scheduled and actioned at a time. Batched or simultaneous requests are not permitted.
- A turnaround time of 2 business days per task applies.
- Requests outside the scope of text and image changes (including new page builds, design changes, plugin installations, e-commerce configuration, and development work) are not included and may be quoted separately.
6. Hack Recovery Guarantee
The hack recovery guarantee included in all monthly plans covers the restoration of your WordPress website in the event of a security compromise, at no additional charge, subject to the following conditions:
- Your site must be actively under a current Web Security Pro monthly subscription at the time of the incident.
- The compromise must not have resulted from changes made by you, your team, or a third party that bypassed or disabled our security infrastructure.
- The guarantee does not cover loss of data that predates your subscription or data not captured by our backup schedule.
7. Intellectual Property Rights
- All intellectual property rights in materials, tools, processes, and systems developed or used by us in providing the services remain our property unless otherwise agreed in writing.
- Upon full payment of all fees, we assign to you all intellectual property rights in deliverables specific to your project, except for our background IP and any third-party licences.
- Each party retains ownership of their background IP and grants the other party a non-exclusive, royalty-free licence to the extent necessary to perform obligations under these Terms.
- We reserve the right to display work created for you in our portfolio and marketing materials.
Background IP means intellectual property rights owned by either party prior to the date of this agreement or developed independently of it.
8. Warranties and Liability
- We warrant that we will provide the services with reasonable care and skill.
- To the extent permitted by law, all other warranties, conditions, and representations are excluded. Where a statutory guarantee cannot be excluded, our liability is limited to re-supplying the services or paying the cost of having them re-supplied.
- We do not guarantee that our services will make your website completely immune from all cyber threats or that they will achieve any specific business outcome, including search engine rankings, advertising account status, or revenue results.
- To the extent permitted by law, we will not be liable for any indirect, consequential, or special loss, including loss of revenue, loss of profits, loss of data, or loss of business opportunity.
- Our total aggregate liability to you under or in connection with these Terms will not exceed the total fees paid by you to us in the three (3) months preceding the event giving rise to the claim.
- You indemnify us against all claims, losses, damages, and costs (including legal costs on a full indemnity basis) arising from your breach of these Terms, any infringement of third-party intellectual property rights by you, or any act or omission by you in connection with the services.
9. Confidentiality
- Each party agrees to keep the other party's confidential information strictly confidential and not to disclose it to any third party except as required by law, or to employees, contractors, or advisers on a need-to-know basis.
- Confidential information includes, but is not limited to, login credentials, technical configurations, pricing data, customer lists, and business processes shared between the parties.
- Confidentiality obligations survive the termination of these Terms.
- This clause does not apply to information that is or becomes publicly available other than through a breach of confidence.
10. Termination
- Either party may terminate a monthly subscription by giving 30 days written notice.
- We reserve the right to suspend or terminate services immediately and without liability if you fail to make payments when due, breach any material term of these Terms, or engage in conduct that we reasonably consider harmful to our systems, staff, or other clients.
- Upon termination, all outstanding fees for services rendered remain payable.
- Termination does not affect any rights or obligations that have accrued prior to the date of termination.
11. Non-Solicitation
During the term of your engagement with us, and for a period of 6 months following its conclusion, you must not directly solicit, employ, or engage any of our staff or contractors who were involved in providing your services.
12. General
- These Terms are governed by the laws of Queensland, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Queensland.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
- These Terms constitute the entire agreement between the parties in relation to the services and supersede all prior representations, negotiations, and understandings.
- Our failure to enforce any provision of these Terms does not constitute a waiver of that right.
- You may not assign your rights or obligations under these Terms without our prior written consent.
